Well sorta, but that's the point, Apple have flexibility because of the way they have gone around their business.
You are still running windows on the mac, you still have the mac hardware, you are not playing it in the mac os.
Even so, that's not Apples fault, that's the game companies fault.

On the other hand - Direct X, that is owned/made(?) by Microsoft, Microsoft won't allow Apple to use that because Microsoft needs to stay where they are strongest, the gaming market.

OpenGL is still very good, I haven't done a comparison but I have heard that OpenGL is better than DirectX but not used as much, not as well known. Dunno..

You can run a hacked projectx86 version of mac on your pc but it is illegal, doesn't support driver updates and is really slow and buggy - not worth it IMHO.
